1. Agreement
By accessing or using CaliCombos (the “Service”), you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service. CaliCombos is a service operated by Tolbert Technologies LLC. “We,” “us,” and “our” refer to Tolbert Technologies LLC.
We may update these Terms. We will post the new effective date and give additional notice when a change materially affects your rights. Continued use after an update takes effect means you accept the updated Terms.
2. Eligibility
You must be at least 16 years old to use the Service. If you are under the age of legal majority where you live, a parent or legal guardian must review and agree to these Terms for you. The Service is not directed to children under 13, and they may not create accounts, upload media, chat, stream, or participate in battles.
You may use the Service only where it is lawful and only if you are able to form a binding agreement.
3. Fitness, safety, and automated-analysis disclaimer
CaliCombos is for general fitness and entertainment information. It is not medical advice, diagnosis, treatment, physical therapy, professional coaching, or a substitute for a qualified clinician or trainer.
- Calisthenics, inversions, weighted movements, competition, and training near equipment can cause falls, overuse injuries, serious injury, or death. You assume the risks of choosing and performing any activity.
- Consult a qualified healthcare professional before starting or changing exercise, especially if you have an injury, medical condition, are pregnant, or have concerns about your ability to exercise safely.
- Stop immediately and seek appropriate help if you experience pain, faintness, chest pain, unusual shortness of breath, loss of balance, or other concerning symptoms. Call local emergency services for an emergency.
- Inspect equipment and surroundings, use appropriate mats or spotters, progress within your ability, and never rely on a generated combo as a safety assessment.
- Rep counts, pose estimates, form grades, match scores, movement labels, 3D views, and other AI or automated outputs are estimates. Camera angle, clothing, lighting, occlusion, device performance, and model limitations can make them wrong. Review outputs yourself before relying on them.
- Do not use the Service to make medical, employment, insurance, eligibility, or other high-impact decisions.
4. Accounts and security
Some features work without an account; social and competition features require Google sign-in. Before Google sign-in, you must complete our 16+ eligibility check and record your agreement to these Terms. You must provide accurate information, keep your Google account secure, and promptly notify us of suspected unauthorized use. You are responsible for activity through your account unless caused by our failure to use reasonable security.
Usernames are assigned from account information and may be visible. You may edit profile visibility settings, but no online system or privacy setting can guarantee that another person will not copy content they can access.
We may suspend or terminate access when reasonably necessary to protect users, enforce these Terms or the Community Guidelines, comply with law, or protect the Service.
5. Your content
You retain ownership of videos, images, captions, messages, profile material, workout combinations, and other content you submit (“User Content”). You represent that you have the rights and permissions needed to submit it, including permission from every identifiable person shown or heard.
You grant us a non-exclusive, worldwide, royalty-free license to host, store, reproduce, process, adapt for technical formatting, transmit, display, and otherwise use User Content only as needed to operate, secure, moderate, and improve the Service and to honor the visibility choices you make. This license ends when the content is deleted, except for reasonable backup, legal, safety, fraud-prevention, and match-evidence retention.
Public content may be viewed and shared by anyone. Unlisted content may be accessed by anyone with the link. Private content remains subject to the access rules described in the Service. Do not upload content you consider confidential.
Feedback and suggestions may be used without restriction or compensation, but we will not publicly identify you as the source without permission.
7. Acceptable use
You may not:
- break the law, violate another person’s rights, impersonate someone, or submit media without necessary consent;
- harass, threaten, exploit, sexualize, dox, or endanger another person, including a minor;
- upload malware or unlawful, deceptive, hateful, violent, sexually explicit, or privacy-invasive content;
- cheat, manipulate votes or scores, submit someone else’s performance, or misrepresent automated results;
- probe, scrape, overload, reverse engineer, bypass access controls, extract models, or interfere with the Service except where applicable law expressly permits;
- use the Service or its outputs to train a competing model or product without written permission; or
- sell accounts, send spam, run unauthorized advertising, or use the Service for commercial competitions without permission.
8. Third-party services and changes
The Service depends on third parties such as Google sign-in, hosting, storage, network, and real-time media providers. Their services and terms may also apply. We are not responsible for third-party services we do not control.
We may add, change, suspend, or discontinue features. We aim to avoid unnecessary data loss but do not promise uninterrupted availability, permanent storage, or compatibility with every device. Keep copies of content you need.
9. Disclaimers and limitation of liability
To the fullest extent permitted by law, the Service is provided “as is” and “as available.” We disclaim implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranty that workout content, analysis, scoring, security, or availability will be accurate, safe, uninterrupted, or error-free.
To the fullest extent permitted by law, Tolbert Technologies LLC and its owners, officers, employees, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, goodwill, opportunities, or physical injury arising from reliance on generated or automated content. Our total liability for claims relating to the Service will not exceed the greater of US $50 or the amount you paid us for the Service during the 12 months before the event giving rise to the claim.
Some jurisdictions do not allow certain exclusions or limits. In those jurisdictions, these provisions apply only to the extent permitted. Nothing in these Terms excludes liability that cannot lawfully be excluded.
You agree to indemnify Tolbert Technologies LLC and its owners, officers, employees, and service providers from third-party claims arising from your User Content, unlawful use, or material breach of these Terms, to the extent permitted by law.
10. Disputes and general terms
Before filing a formal claim, contact us and describe the issue so we can try to resolve it informally. Except where applicable law requires otherwise, these Terms are governed by the laws of the Commonwealth of Virginia, without regard to conflict-of-law principles. Courts with lawful jurisdiction will resolve disputes. Nothing in these Terms waives nonwaivable consumer protections or rights available where you live.
If any provision is unenforceable, it will be limited to the minimum extent necessary and the remaining provisions will continue. Our failure to enforce a provision is not a waiver. You may not transfer your account or these Terms without permission; we may transfer them as part of a reorganization or sale of the Service. These Terms, the Privacy Policy, the Health Data Privacy Policy, and Community Guidelines are the entire agreement about the Service.
